Print, Paper, and Product Disclaimer
Of The Earth does make best practice recommendations for printing compatibility on our various papers from our own in house testing and individual paper mill specifications. However, in regards to printing, equipment, paper compatibility and personal results we do not and can not explicitly guarantee verbally or written each consumer application. There are all types of consumer and professional printers on the market, each with their own mechanical and technical makeup. Further, all inks are not the same and papers will react differently to different inks.
To help with the process, we offer samples of our papers for testing your specific application on your specific printer. While some of our papers are suitable for conventional printing including offset, thermography, engraving, letterpress and on demand, if you plan on using the services of an outside printer we encourage you to consult them in regards to your printing needs.
Of The Earth shall not be liable, in any way, for incidental or consequential damages or losses sustained, or aggravated, by print or paper recommendations whether or not made verbally or in writing on this website. This is the sole and exclusive responsibility of the consumer. Additionally the limit to our liability on products not delivered on time due to human error, act of god or supplier error is the full cost of the materials purchased including freight costs.
Of The Earth will not under any circumstances be liable for any damages whatsoever, including any special, indirect, incidental, consequential or exemplary damages resulting from the delivery of our goods or services, due to any cause, even if Of The Earth was the cause of the print error or late delivery of goods. In any event, Of The Earth's total liability to you for all damages (Whether based on contract, torte or other theories) will be limited to the amount you actually paid for the service or goods supplied. Some states and jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages so the above limitation may not apply to you.
Of The Earth warrants that the seed papers contain high quality viable seed. This is the sole warranty; we make none other, express or implied. We cannot guarantee establishment of plants due to various factors over which we have no control. No liability hereunder shall be asserted unless the buyer or user reports to Of The Earth within a reasonable period of time (not to exceed 60 days of receipt of goods) any conditions that might lead to a complaint. Our liability is limited to the purchase price of the paper only. We do rigorously test our seeds and papers to ensure germination of the products we ship.
The purpose of this clause is to ensure that the good work that is done by Of The Earth can continue should a simple human error be made.
